Future Delivery & Data Retention Policy

Effective Date: September 8, 2026

1.Purpose

Every Era Moments enables users to create, store, and schedule future-delivery messages, keepsakes, legacy content, and other communications for delivery at a future date selected by the user.

This Policy describes how Every Era Moments manages future-delivery content, account activity requirements, data retention practices, recipient information, and long-term storage considerations.

For information about how Every Era Moments collects, uses, processes, secures, shares, retains, and otherwise protects User Content and personal information, please refer to our Privacy Policy.

Nothing in this Policy limits or modifies the Company's rights, obligations, or practices described in the Privacy Policy or Terms of Service, including with respect to legal compliance, disclosures required by law, or the protection of the Company's rights, users, or the Services.

2.Future Delivery Services

Users may schedule content for future delivery to designated recipients on future dates selected through the Services.

Every Era Moments will use commercially reasonable efforts and good-faith attempts to store, maintain, and deliver scheduled content in accordance with user instructions.

However, Every Era Moments does not guarantee successful delivery due to circumstances beyond its reasonable control, including invalid recipient information, technology failures, legal restrictions, third-party service interruptions, recipient actions, cybersecurity incidents, force majeure events, or changes in technology over time.

3.Delivery Attempts

Where appropriate, Every Era Moments may make multiple commercially reasonable attempts to deliver scheduled content.

The timing, frequency, method, and number of delivery attempts shall be determined by the Company in its reasonable discretion and may vary based on the type of content, delivery method, recipient information, technical considerations, or other circumstances.

Additional delivery attempts may occur following delivery failures, temporary service interruptions, bounced communications, or other circumstances that may reasonably affect successful delivery.

The Company does not guarantee that any additional delivery attempts will result in successful delivery.

Nothing in this Policy shall obligate the Company to continue delivery attempts indefinitely or beyond commercially reasonable efforts.

4.User Content Modifications

Users may modify, replace, reschedule, update, or delete future-delivery content and delivery instructions prior to delivery, subject to technical limitations, subscription requirements, preservation plans, and Company policies.

Users are responsible for reviewing and confirming the accuracy of future-delivery content, recipient information, delivery dates, and delivery instructions.

Once content has been delivered, Every Era Moments may be unable to retrieve, modify, revoke, recall, or delete such content.

The Company reserves the right to establish reasonable deadlines, restrictions, verification procedures, or processing requirements relating to modifications of future-delivery content, particularly for content scheduled for imminent delivery.

Nothing in this Policy guarantees that modifications submitted immediately prior to a scheduled delivery date will be successfully processed before delivery occurs.

> 5. User Responsibility

Users are responsible for:

(a)maintaining current account information;

(b)maintaining current recipient information;

(c)reviewing scheduled deliveries periodically;

(d)updating recipient contact information when necessary; and

(e)ensuring that future-delivery instructions remain accurate and desired.

> 6. Annual Account Reminders

To help maintain the accuracy of future-delivery instructions and recipient information, Every Era Moments may send annual reminder communications to account holders.

These reminders may include requests to:

(a)verify account information;

(b)review scheduled deliveries;

(c)update recipient information;

(d)confirm continued account activity; and

(e)review delivery preferences.

Failure to respond to reminder communications shall not automatically result in deletion of content or cancellation of future deliveries.

> 7. Account Verification

Every Era Moments may require users to verify their accounts periodically.

Verification may occur approximately every three (3) years or at such other intervals as the Company determines appropriate.

Verification may include confirmation of:

(a)account ownership;

(b)contact information;

(c)future-delivery instructions;

(d)recipient information; and

(e)continued account activity.

The Company may use email verification, multi-factor authentication, account login activity, or other reasonable verification methods.

> 8. Long-Term Future Deliveries

Future deliveries scheduled more than ten (10) years into the future may require additional verification and review procedures.

Such procedures may include:

(a)additional account verification;

(b)periodic confirmation of delivery instructions;

(c)recipient information verification;

(d)review of delivery methods;

(e)confirmation of continued user intent; and

(f)migration of content to updated storage or delivery systems.

The Company reserves the right to modify long-term delivery procedures as technology and operational requirements evolve.

Procedures may evolve over time as technology, law, and industry standards change.

> 9. Inactive Accounts

An account may be deemed inactive if:

(a)the user has not logged in for an extended period;

(b)the Company is unable to contact the user using the information provided;

(c)repeated verification requests remain unanswered; or

(d)other circumstances reasonably indicate abandonment of the account.

The Company may establish specific inactivity thresholds from time to time.

10. Pending Future Deliveries for Inactive Accounts

An account's inactive or archived status does not, by itself, cancel future deliveries that were scheduled before the account became inactive or archived.

Where an inactive or archived account contains pending future-delivery content, Every Era Moments may continue to retain the content, recipient information, delivery instructions, and other information reasonably necessary to preserve and fulfill the scheduled delivery in accordance with this Policy.

Every Era Moments will not delete pending future-delivery content solely because an account has been designated inactive or archived. Scheduled deliveries may nevertheless be modified, suspended, cancelled, redirected, or otherwise managed as permitted by this Policy, applicable law, or valid instructions from the user or another person authorized to act with respect to the account.

Where reasonably practicable, Every Era Moments may attempt to contact the account holder or an authorized Continuity Contact before taking action that would permanently delete pending future-delivery content.

> 11. Archiving Procedures

Prior to archiving, restricting, or deleting content associated with an inactive account, the Company will use commercially reasonable efforts to contact the user using available contact information.

Such efforts may include multiple email notifications, account notices, and other communications reasonably designed to reach the user.

The Company may make multiple attempts to obtain verification before taking action regarding future-delivery content.

> 12. Data Retention

Every Era Moments retains User Content, account information, and future-delivery instructions for as long as reasonably necessary to provide the Services, fulfill scheduled future deliveries, comply with applicable law, maintain security, prevent fraud, resolve disputes, enforce our agreements, and support legitimate business operations.

Retention periods may vary depending on the type of information, account activity, subscription status, delivery schedules, legal requirements, and operational considerations.

Certain information is subject to the following specific retention periods:

Account Download Archives. When a user requests a downloadable archive of their account, the generated archive may contain account information, letters, media, children's profiles, and other User Content. The generated download archive is retained for 7 days and then deleted.

Deleted Child Profiles and Content. When a child profile is deleted, the associated child profile, content, and media are retained for up to 30 days before being permanently removed, subject to applicable legal, security, backup, and other permitted retention requirements.

Unsaved Letter Drafts. Unsaved drafts of letters are retained for up to 60 days and then deleted if they have not been saved.

Pending Account-Link Requests. Pending account-link requests, including associated email addresses, are retained for up to 7 days and then deleted if the request has not been completed.

Deleted Family Members. When a family member is deleted from the Services, information associated with that family member is retained for up to 30 days before being deleted, subject to applicable legal, security, backup, and other permitted retention requirements.

Retention practices are also subject to applicable user deletion requests, legal obligations, and the Company's Privacy Policy. Where a user requests deletion of content or an account, Every Era Moments will process such requests in accordance with applicable law, the Privacy Policy, the Terms of Service, and this Policy.

Certain information may be retained beyond the periods described above where reasonably necessary to comply with applicable law, resolve disputes, enforce agreements, prevent fraud or abuse, protect the security and integrity of the Services, fulfill valid future-delivery or preservation obligations, or as otherwise permitted or required by law.

> 13. Confidentiality of Future-Delivery Content

Every Era Moments recognizes that future-delivery content often contains deeply personal, sensitive, and meaningful information.

Except as described in the Privacy Policy, Every Era Moments does not review, access, or disclose future-delivery content except as reasonably necessary to provide and maintain the Services, respond to user requests, comply with applicable law, investigate fraud, abuse, or security incidents, enforce the Company's agreements, or protect the rights, safety, security, and integrity of the Company, its users, recipients, or the Services.

> 14. Future Delivery Preservation Fees

Every Era Moments may offer paid future-delivery preservation services in the future. If and when such services become available, the following terms will apply.

Certain future-delivery services may require payment of one-time preservation, storage, maintenance, or delivery fees.

Applicable fees, coverage periods, storage limits, message limits, and related terms will be disclosed at the time of purchase.

Unless otherwise expressly stated at the time of purchase, payment of a Future Delivery Preservation Fee will not guarantee perpetual storage or delivery but will entitle the user to the level of service described in the applicable offering.

> 15. Recipient Information Changes

Users are solely responsible for maintaining accurate recipient information.

The Company is not responsible for failed deliveries resulting from outdated, inaccurate, incomplete, or invalid recipient information.

The Company may, but is not obligated to, provide tools that allow users to update recipient information after scheduling future deliveries.

> 16. Recipient Opt-Out Requests

Recipients may request that future communications not be delivered to them.

The Company reserves the right to honor such requests and may suspend or prevent future deliveries to affected recipients.

> 17. Business Continuity

In the event of a merger, acquisition, sale of assets, restructuring, financing transaction, or other corporate transaction, future-delivery obligations and associated content may be transferred to a successor entity.

In the event Every Era Moments permanently ceases operations, the Company may provide users with an opportunity to retrieve content or may take other commercially reasonable actions under the circumstances.

The Company does not guarantee perpetual operation of the Services.

> 18. Technology Changes

Every Era Moments may use trusted third-party service providers to support the Services, including providers that facilitate cloud storage, communications, authentication, security, artificial intelligence functionality, content processing, payment processing, analytics, and future-delivery services. These providers process information on the Company's behalf in accordance with applicable agreements and as further described in the Company's Privacy Policy.

User Content and personal information may be processed or stored by the Company or its service providers in jurisdictions in which the Company or its trusted service providers operate, as described in the Privacy Policy. Information regarding international data processing and applicable safeguards is described in the Company's Privacy Policy.

Technology, communication methods, delivery systems, email providers, artificial intelligence systems, storage technologies, and internet infrastructure may change over time.

Every Era Moments reserves the right to modify, replace, migrate, update, or discontinue technologies used to provide future-delivery services as necessary to maintain, improve, or support the Services.

> 19. Future Delivery Methods

The Company may modify, replace, supplement, or discontinue delivery methods from time to time as technology evolves.

Where reasonably practicable, the Company may use alternative delivery methods that are substantially similar to the delivery method selected by the user.

The Company does not guarantee the continued availability of any specific delivery channel, platform, provider, communication technology, email service, messaging service, social platform, or delivery mechanism.

The Company reserves the right to implement new delivery technologies or retire obsolete delivery technologies as necessary to support the Services.

> 20. Content Preservation and Format Migration

The Company may migrate, convert, compress, archive, reformat, duplicate, reorganize, or otherwise modify stored content as reasonably necessary to maintain compatibility, accessibility, preservation, security, storage efficiency, operational continuity, or technological relevance.

The Company will use commercially reasonable efforts to preserve the integrity, intended meaning, and usability of content during any migration, conversion, or preservation process.

Users acknowledge that certain file formats, media formats, communication standards, storage technologies, and software systems may become obsolete over time and that preservation efforts may require modification of content formats or delivery methods.

> 21. Identity Verification

The Company may require reasonable identity verification, proof of authority, legal documentation, authentication procedures, account verification measures, or other evidence before granting requests relating to future-delivery content, account administration, Continuity Contact authority, beneficiary requests, recipient changes, account recovery, deceased-user accounts, or incapacitated-user accounts.

The Company reserves the right to deny requests that cannot be adequately verified or that may expose the Company, users, recipients, or third parties to fraud, unauthorized access, privacy violations, or legal risk.

> 22. Death or Incapacity of an Account Holder

Trusted Contacts and Continuity Contacts

The Company may offer users the ability to designate one or more trusted contacts, backup contacts, beneficiaries, Continuity Contacts, or account representatives for purposes relating to future-delivery services.

A Continuity Contact is an individual designated by the user to communicate with the Company regarding the user's account in the event of the user's death, incapacity, or other circumstances determined by the Company.

Unless otherwise expressly authorized by the user and permitted by applicable law, a Continuity Contact shall not automatically receive access to the user's account, User Content, future-delivery content, messages, keepsakes, account credentials, or private information.

The Company may communicate with trusted contacts, beneficiaries, and Continuity Contacts in accordance with user instructions, applicable law, and Company policies.

Authorized Representatives

In the event of a user's death, incapacity, or other circumstances permitted by applicable law, Every Era Moments may, subject to applicable law and reasonable verification procedures, permit an authorized representative, executor, administrator, guardian, conservator, trusted contact, beneficiary, Continuity Contact, or other legally authorized person to communicate with the Company regarding the user's account.

The Company reserves the right to require documentation reasonably necessary to verify authority before taking any action relating to a user's account.

Continuity Contact Authority

If offered by the Services, users may authorize a Continuity Contact to perform specific actions designated by the user, which may include:

(a)updating recipient contact information;

(b)confirming delivery instructions;

(c)receiving delivery status information;

(d)requesting preservation of account content;

(e)assisting with future-delivery administration; or

(f)other actions expressly authorized by the user through the Services.

The scope of any Continuity Contact's authority shall be determined by the user's instructions, applicable law, and Company policies.

Appointment as a Continuity Contact does not automatically authorize an individual to exercise privacy rights, submit privacy requests, or act as an authorized agent on behalf of a user unless otherwise permitted by applicable law or expressly authorized by the user.

Company Discretion

Nothing in this Policy obligates the Company to provide account access, modify delivery instructions, disclose content, release account information, or take any specific action except as permitted by applicable law and Company policies.

> 23. Delivery Confirmation

Every Era Moments may provide users, Continuity Contacts, authorized representatives, or other authorized individuals with delivery status information, delivery confirmations, transmission records, read receipts, engagement information, or similar delivery-related information where supported by the applicable delivery method and technology.

Delivery status information may include, without limitation:

(a)confirmation that a delivery attempt was made;

(b)confirmation that a message was transmitted;

(c)confirmation that a communication was opened or accessed, where technically available;

(d)delivery failure notifications; and

(e)other information relating to the status of a scheduled delivery.

The availability, accuracy, completeness, and reliability of delivery status information may depend upon third-party providers, recipient systems, email services, technology limitations, privacy settings, and other factors outside the Company's control.

Accordingly, Every Era Moments does not guarantee the availability, accuracy, completeness, or reliability of any delivery confirmation, delivery status information, read receipt, engagement metric, or similar information.

The absence of a delivery confirmation shall not necessarily indicate that a delivery was unsuccessful, and the presence of a delivery confirmation shall not necessarily indicate that a communication was read, understood, retained, or acted upon by a recipient.

> 24. Recipient Circumstances

Every Era Moments recognizes that circumstances affecting intended recipients may change over time.

The Company reserves the right to suspend, delay, redirect, cancel, modify, or otherwise manage a scheduled delivery where the Company reasonably believes that delivery may be:

(a)impossible;

(b)unlawful;

(c)fraudulent;

(d)harmful;

(e)abusive;

(f)inappropriate under the circumstances;

(g)inconsistent with applicable law; or

(h)inconsistent with the intended purpose of the Services.

Examples of circumstances that may affect delivery include, without limitation:

(i)the death of a recipient;

(ii)invalid or inactive recipient contact information;

(iii)legal disputes concerning the content or delivery;

(iv)evidence of fraud, coercion, or unauthorized account activity;

(v)recipient opt-out requests; or

(vi)circumstances that may create a material risk of harm to a recipient or third party.

The Company shall have no obligation to independently investigate recipient circumstances and may rely upon information reasonably available to it at the time any decision is made.

Any decision regarding the suspension, delay, modification, redirection, or cancellation of a scheduled delivery shall be made in the Company's reasonable discretion and in accordance with applicable law and Company policies.

> 25. Sensitive Content

Users acknowledge that future-delivery content may contain emotionally significant, personal, memorial, sentimental, family-related, or otherwise sensitive information.

Recipients may experience emotional, personal, relational, psychological, or other reactions to content delivered through the Services.

Users are solely responsible for determining the appropriateness, timing, content, recipients, and potential impact of any content scheduled for future delivery.

Every Era Moments does not review, evaluate, endorse, or assess the emotional suitability of future-delivery content and shall not be responsible for the emotional, personal, relational, psychological, reputational, or other effects arising from content created, uploaded, scheduled, generated, transmitted, or delivered by users.

The Company encourages users to exercise thoughtful judgment when creating future-delivery content, particularly when such content relates to family relationships, memorials, significant life events, health matters, financial matters, end-of-life communications, or other sensitive topics.

> 26. Data Preservation Limitations

While the Company employs technical, administrative, and organizational safeguards, including security, backup, redundancy, monitoring, and preservation measures designed to protect User Content, no storage system, technology platform, or preservation process can guarantee absolute protection against loss, corruption, destruction, unauthorized access, cyberattack, technological failure, natural disaster, force majeure event, or other unforeseen circumstances.

Users are encouraged to maintain independent copies of important content, memories, photographs, videos, voice recordings, documents, and other materials.

The Company does not guarantee that any content will remain available indefinitely or be immune from loss under all circumstances.

> 27. Policy Updates

The Company may update this Policy from time to time to reflect changes in technology, legal requirements, operational practices, or Service offerings.

Material changes will be communicated in accordance with applicable law and the Company's Terms of Service.
